Terms of service

Draft, pending legal review. These terms are a plain-English draft and haven’t been reviewed by a lawyer yet. Your signed project agreement controls if it says something different.

Who we are

Samonte Digital (“we”, “us”) is a small web design and marketing agency based in California. Questions about these terms: connect@samontedigital.com.

Using this website

You can browse this site and contact us through it. Please don’t misuse it, try to break it, or send spam through the contact form. Sample and portfolio concepts on this site are for illustration only.

Scope of work

Every project starts with a written quote or agreement that lists what we’ll deliver, the timeline, and the price. Work outside that scope is quoted separately before we start it.

Payment

Payment terms (deposits, milestones, and due dates) are set out in your quote or invoice. We may pause work on overdue accounts until they’re brought up to date.

Your content and ownership

You’re responsible for having the rights to the text, photos, logos, and other materials you give us. Once you’ve paid in full, you own the final deliverables made for you, except third-party items (such as fonts, stock photos, plugins, or hosting) that stay under their own licenses. We may show finished work in our portfolio unless you ask us not to.

No guarantees

We work hard to get you results, but we can’t promise specific rankings, traffic, leads, or revenue. Search engines, ad platforms, and other third-party services change on their own and are outside our control.

Limitation of liability

To the extent the law allows, our total liability for any project is limited to the amount you paid us for that project, and we aren’t liable for indirect or consequential losses such as lost profits.

Ending a project

Either side can end a project with written notice. You pay for work completed up to that point, and we hand over what’s been finished and paid for.

Changes and governing law

We may update these terms from time to time; the date at the top of the final version will show when. These terms are governed by the laws of the State of California.
